“A complaint of allotment of a flat to ‘ghost’ applicant under MHADA’s public lottery scheme in 2007, has been lodged by a Goregon-based cooperative housing society with the President and CEO of the MHADA.”
“The flat 602, in New Dindoshi Chaitanya CHS. Ltd. was allotted under code No.195 to one Milind Kolkar on May 30 2007. However said Kotkar neither turned up in the society nor registered his flat documents. He signed an agreement on July 9,2007, along with an “Irrevocable Power of Attorney” in favour of one Tripta Sharma (stated to be mother-in-law of one Vijay K Chavan, who later claimed to be the owner of the flat). Kolkar subsequently sold the flat to her. This deal took place within 40 days although as per rules the flat should not be transferred/sold till 5 years from the date of allotment, the society in its letter dated 5 October 2020 pointed out.”
“Besides there are two agreements for sale executed for the said flat with same buyer. The first one is dated 9 th July 2007 and the 2 nd one is dated 23 rd February 2017, showing that this is a clear case of misrepresentation and Benami transaction.”
“In between Vijay K. Chauhan approached the society claiming that he was the owner of the flat and his name be registered in the society documents. When the society refused, he allegedly threatened the office bearers of the society with dire consequences.”
“In another development, the flat was given on leave-n-license in 2008, 2009, 2018 and 2020 to different parties. However leave n license agreements were signed neither by Kolkar, nor Tripta Sharma nor Vijay Chavan but by one Babita Chauhan, raising the question about the real owner of the flat.”
Deputy Registrar of cooperative societies Bajrang Jadhav also allegedly played a ‘fishy’ role in the deal. In his order dated 09 September 2020 he stated that the shares of the flat cannot be transferred in favour of Vijay Chavan. Whereas in his order dated 15 September 2020 he gave NOC for transferring the flat in the name of Tripta Sharma. In another words he changed his own order within 6 days.
“The society in its letter dated 10 October 2020, to Deputy Registrar of cooperative societies Bajrang Jadhav, has pointed out his erroneous orders and has also stated that as per the directions of the Bombay High Court dated 2 nd September 2020, he cannot issue such unilateral orders. The society has forwarded the copies of this letter to the Housing Minister Minister for Cooperatives and Anti Corruption Bureau among others. The further hearing of the case with Deputy Registrar is scheduled to be held on 29 October 2020.”
“According to society this is apparently a clear case of Benami Transaction, probably initiated by Vijay K. Chauhan, using a fictitious applicant Milind Kolkar. How the flat was allotted, whether MHADA verified relevant documents before clearing the allotment is another pertinent question.”
“The society in its letter has urged to MHADA President to cancel the flat allotment and take back the possession of the flat and also look into other criminal aspects, that have taken place after the flat was released in the name of Kholkar. The society is represented by M/s. Solicis Lex, Advocate and Solicitors. The clarification from MHADA in the matter was awaited.”
